General terms and conditions

1.Service Description

1.1.FlowCV is an online services platform or all-in-one platform (in short "online services platform") and offers its users at https://flowcv.com, https://flowcv.me, https://flowcv.io, as well as all subdomains, the quick and easy possibility of creating resumes, in each case based on the data provided by the respective user. FlowCV is operated by UNIQKORN Creative GmbH, FN 442984 y, Lindauergasse 23, 1230 Vienna, Austria (in short "UNIQKORN").

1.2.The aim of FlowCV is to enable its users, through the use of user-friendly applications and services, as well as through careful use of artificial intelligence (hereinafter "AI"), to create online and easily a modern and visually appealing resume (also "CV" or "curriculum vitae").

1.3.In addition to creating resumes, FlowCV offers its users the ability to create cover letters, use application trackers, design personal websites, and create email signatures.

1.4.FlowCV offers both free and paid services.

1.5.The digital works created by the user through FlowCV's services depend significantly on the information provided by the user and the use of FlowCV's available services, and it is the sole responsibility of each user to use the created works accordingly. UNIQKORN therefore assumes no warranty that the works created by users through FlowCV will meet the expectations of users, for example in connection with an application process. Users decide independently and on their own responsibility whether and if so how they use the works created via FlowCV and whether they use them, for example in application processes.

1.6.The user is responsible for the accuracy and completeness of the data provided. In principle, no data will be passed on to third parties. UNIQKORN is entitled to store content and pass it on to third parties, as far as this is required by law or is necessary and legally permissible according to dutiful discretion, for example to fulfill legal regulations or judicial or official orders.

1.7.All notifications concerning the users will be sent to the e-mail address associated with the respective account or to the user by other legally permissible means.

1.8.UNIQKORN can change, extend or discontinue the scope of services on the online services platform at any time.

2.Registration, Password, Security

2.1.In order to use FlowCV to its full extent, the user can register on the online services platform.

2.2.A user may only have one account. If it is determined that a user has multiple accounts, UNIQKORN reserves the right to block all affected accounts, irrevocably delete them, and terminate the user relationship with the affected user with immediate effect.

2.3.In the registration process, the user must provide current, complete and correct information regarding the data requested in the registration form. The user can choose a password and username. Users themselves are solely responsible for keeping their password and account confidential. Users are also solely responsible for all activities on their account.

2.4.The user is obliged to inform UNIQKORN immediately about any unauthorized use of his account or any other security breach. UNIQKORN is not liable for damages caused to the user by third parties using his password or account with or without his knowledge.

2.5.There is a possibility that the user may be held liable for losses incurred by UNIQKORN or another party due to the use of the user's account or password by a third party. It is not allowed to use the account of a third party without their permission.

2.6.Registered users may duly terminate the usage relationship at any time via the online services platform or e-mail to [email protected] (in short "termination").

2.7.After the cancellation, the user's account will be deactivated as soon as possible.

2.8.Upon termination of use or revocation, all personal data provided by the user during registration will be deactivated and stored or deleted in accordance with the applicable legal retention periods. In addition, at the request of the user, all personal data relating to the user that is no longer required to fulfill the business relationship with the user and is not subject to a legal retention period will be permanently deleted. This requires an e-mail with the e-mail address provided during registration and the request for final deletion to [email protected].

3.Code of Conduct

3.1.The use of FlowCV requires a minimum age of 18 years. For users under the age of 18, the consent of a parent or guardian must be obtained who undertakes to comply with these GTC before using FlowCV.

3.2.The use of FlowCV is permitted under the condition that the Applications or Services are not used for purposes that are unlawful or in violation of these General Terms and Conditions.

3.3.The services may not be used in a way that could damage, disable, overload or impair a server used by UNIQKORN or the networks connected to such a server, or that could impair the use of the services by third parties (such as the use of FlowCV by bots and the like). It is not permitted to gain unauthorized access to services, accounts, computer systems or networks connected to a server used by UNIQKORN or one of the services by hacking codes, illegally obtaining passwords or other methods. Furthermore, it is not permitted to obtain or attempt to obtain materials or information through means that are not consciously made available through the services.

3.4.In case of violation or suspicion of violation of these general terms and conditions, UNIQKORN can at any time block access to services, accounts, computer systems or networks of UNIQKORN or which are used by UNIQKORN and, if applicable, irrevocably delete corresponding accounts as well as associated data and terminate the user relationship with the respective user with immediate effect.

3.5.The user must immediately report any violations of the obligations listed under point 3 by e-mail to [email protected].

3.6.UNIQKORN assumes no liability for the contents published or distributed by the users within the framework of services provided by means of the online services platform.

3.7.The use of the online services platform is permitted exclusively for non-commercial purposes. Any use of the online services platform for commercial purposes without the written consent of UNIQKORN is expressly prohibited.

4.Privacy

4.1.The collection, processing and use of FlowCV's data is always carried out in accordance with the applicable legal provisions, in particular in accordance with the General Data Protection Regulation (GDPR), the Data Protection Act 2018 (DPA), the e-Privacy Directive and the Telecommunications Act 2021 (TKG 2021), as well as other applicable national and EU regulations.

4.2.All data provided by the user will be treated confidentially and used exclusively for the purpose of using the services offered by UNIQKORN via FlowCV. Any further use of data will only be made on the basis of a separate consent given by the user. Data will only be passed on to third parties on behalf of the user.

4.3.Through the feedback and template links generated on behalf of users, as well as the use of hosted or maintained resumes, such as the "Online Resume", or similar services offered on FlowCV, third parties may gain insight into the data transmitted and processed by FlowCV. FlowCV assumes no liability for the handling of this data by third parties.

5.Intellectual Property

5.1.All content included in or made available through the Services, such as text, graphics, logos, icons, images, illustrations, sounds, music, instructions, data collections, software and documents, are the exclusive (intellectual) property of UNIQKORN and are protected by the various applicable laws. All rights not expressly granted to users in these GTCs are reserved and remain with UNIQKORN or its rights holders or other content providers.

6.Warranty and Liability for the Services Offered on FlowCV

6.1.The works created via the services offered on FlowCV are exclusively created by the users independently and on their own responsibility. UNIQKORN takes the greatest possible care in the ongoing implementation and updating of the services as well as the processing of the data provided by the user within the services offered on FlowCV. Nevertheless, transmission errors, technical interruptions, and errors may occur in individual cases. UNIQKORN does not assume any liability for lost or damaged data, as well as other errors of the offered services, data loss or the like.

6.2.UNIQKORN does not give any assurance about the suitability, availability or quality of the works created by means of FlowCV and in particular does not assume any liability for the availability of these.

6.3.For services offered against payment on FlowCV, the warranty is governed by the statutory provisions of the law applicable to these GTC and, if applicable, the individual contract concluded between UNIQKORN and the user.

6.4.No warranty is given for services offered free of charge on FlowCV and the use is exclusively at the user's own liability.

6.5.UNIQKORN is liable within the framework of the existing legal regulations only if a damage was caused by UNIQKORN, grossly negligent or intentionally. In case of slight negligence UNIQKORN is not liable towards companies and towards consumers only with regard to injury to life, body, health. Liability of UNIQKORN towards companies for consequential damages, mere financial losses, loss of profit, damages from third party claims is excluded.

6.6.UNIQKORN shall not be liable for any downloaded material or any material obtained by the registered user as a result of using the services on FlowCV. The User alone shall be liable for any damage it may cause to its computer system or for the loss of data due to the downloading of any FlowCV service related material.

6.7.UNIQKORN is not responsible for the acts or omissions of other users, nor for any damage resulting from said acts or omissions.

7.Charges

7.1.The current prices for the services offered on FlowCV are available at https://flowcv.com/pricing. The net prices plus sales tax result in the gross prices. Prices may vary depending on the user's location.

7.2.UNIQKORN reserves the right to change its prices at any time.

7.3.Registered users will be informed about upcoming changes in prices in due time and, if necessary, have the possibility to withdraw from existing service relationships within 2 weeks after delivery of the notification about the price change.

7.4.If the user has expressly agreed that he/she can start using the online service platform within the 14-day withdrawal period, UNIQKORN is entitled to payment for services already provided in the event of withdrawal.

8.Revocation

8.1.If the registered user has registered on the online services platform for a purpose that can be attributed neither to his commercial nor to his independent professional activity, the following provisions apply to the registered user as a consumer within the meaning of § 1 of the Consumer Protection Act (in short "KSchG"):

8.2.The registered user can withdraw from the user relationship in writing, e.g. by letter, fax or email, without giving reasons, within 14 days (i) from the day of the conclusion of the contract, or (ii) from the day of receipt of the goods by the Consumer in the case of contracts for the supply of goods. The withdrawal must be sent by email to [email protected] to UNIQKORN.

8.3.In the event of an effective revocation, the services received by both parties must be returned and any benefits received (e.g. interest) must be surrendered. Should the user not be able to return the received services in whole or in part, the user may have to pay compensation to UNIQKORN. This may result in the user having to fulfill the contractual payment obligations for the period until the revocation. Obligations to refund payments must be fulfilled within 30 days. The period begins for the user with the sending of his revocation, for UNIQKORN with its receipt.

9.Links

9.1.The links contained on UNIQKORN's websites allow users to leave UNIQKORN's website and jump to other websites. UNIQKORN is not responsible for the contents, links, changes or updates of other websites.

10.Changes

10.1.UNIQKORN reserves the right to adapt the GTC at any time, especially, but not limited to, to comply with legal regulations or requirements, to meet economic efficiency or to accommodate user interests. The GTC can be viewed in the respective valid version on the online services platform.

10.2.Changes to these GTC require the consent of the registered user. If UNIQKORN wants to change the GTC, UNIQKORN will notify the registered user. Such notification will be made either to the email address provided during registration; or on the relevant pages of the online services platform.

10.3.UNIQKORN will call upon the registered user to accept the new GTC by checking the applicable box "Yes", or "I accept", or a similar consent option. Any change of the GTC will become effective for the user with the user's consent, from the day of publication of the changed GTC.

10.4.If the registered user does not agree to the amended GTC and continues to use the offer of the online services platform after an amendment to the GTC or after notification of the amendment made, or after the expiry of thirty days, this shall be deemed to be his consent to the amended GTC.

10.5.Changes or additions to the GTC must be made in writing. Verbal collateral agreements do not exist.

11.Final Provisions, Formal Requirement, Place of Jurisdiction, Applicable Law and Severability Clause

11.1.The place of jurisdiction is the registered office of UNIQKORN. If the customer is a consumer in the sense of the KSchG and has his domicile, a habitual residence or a place of employment in the country at the time the action is filed, the KSchG shall apply.

11.2.Austrian law shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods and the non-mandatory reference norms of international private law; referrals or re-referrals are excluded.

11.3.Should any provision of these GTC be or become invalid in whole or in part, this shall not affect the validity of the remaining provisions in the GTC.

11.4.These GTC are also provided in English. In case of differences between the German version and the English translation, the German version shall prevail.
